Andrew Napolitano hammers gov’t over claim about NSA computers going dark.

In their continuous efforts to create the impression that the government is doing something to keep Americans safe, politicians in Washington have misled and lied to the public. They have violated their oaths to uphold the Constitution. They have created a false sense of security. And they have dispatched and re-dispatched 60,000 federal agents to intercept the telephone calls, text messages and emails of all Americans all the time.

In the process, while publicly claiming they only acquire identifying metadata – the time, date, location, duration, telephone numbers and email addresses of communications – they have in fact surreptitiously gained access to the content of these communications.

On June 1, one of the three claimed legal authorities for all this, Section 215 of the Patriot Act, expired, as Congress was unable to agree on either its reinstitution or the enactment of a substitute. At the time Section 215 was about to expire, President Obama, Attorney General Lynch and FBI Director Comey warned that the NSA’s computers would go dark and the American public would be at the mercy of our enemies. Their warnings were nonsense.

The NSA is a military entity that utilizes the services of military computer experts and agents, employs civilians and hires companies that provide thousands of outside contractors. After nearly 14 years of spying on us – all authorized by a secret court whose judges cannot keep records of what they have ordered or discuss openly what they know – the NSA now has computers and computer personnel physically located in the main switching offices of all telecom and Internet service providers in the United States. It has 24/7 access to the content of everyone’s telephone calls, emails and text messages.

Judge Napolitano: Bribery Allegations Against Hillary Clinton Are ‘Truly Damning’ (Video)

“They are clearly enough to trigger an investigation. The allegations showed timelines of contributions to the family foundation and decisions made by Mrs Clinton favorable to the contributor. Or contributions to the family foundation and sky-high– $500,000 a speech, unheard of in this business– speaking fees to her husband. Or contributions to the family foundation and two years later, sky-high speaking fees to Mrs. Clinton.”

Fox News senior judicial analyst Judge Andrew Napolitano said on “The Kelly File” Monday the allegations that former Secretary of State Hillary Clinton exchanged favors in return for donations to the Clinton Foundation are “truly damning.”

He also said the Obama Justice Department must launch a criminal investigation.

NAPOLITANO: These allegations are far more serious than those for which Senator Robert Menendez of New Jersey was indicted. And they essentially form the same type of allegation, a quid pro quo: You give cash to me or someone else on my behalf, and I exercise my official governmental judgment in favor of you.

Now I haven’t seen the book; we haven’t seen it. But we’ve read a version of it in the New York Times– or a summary in the New York Times– and the allegations are truly damning. Judge Nap: ‘Hillary Clinton Has Admitted to Destroying Evidence’ (Video)

“She now has admitted to destroying subpoenaed evidence after she was on notice of the existence of the subpoena. That’s known as obstruction of justice, as well as destruction of the documents,” said Napolitano.

Congressional investigators are trying to figure out the next move after learning that Hillary Clinton wiped clean her personal email server last fall.

Rep. Trey Gowdy (R-S.C.), chairman of the Select Committee on Benghazi, criticized Clinton Friday for “unilaterally deciding” to delete the emails. Gowdy added that Clinton made herself the “sole arbiter” of what would be kept and what would be deleted.

“While it is not clear precisely when Secretary Clinton decided to permanently delete all emails from her server, it appears she made the decision after October 28, 2014, when the Department of State for the first time asked the Secretary to return her public record to the Department,” said Gowdy.

Judge Andrew Napolitano reacted this morning to the latest development in the email saga, telling Bill Hemmer said Clinton will be in legal trouble if there is a federal prosecutor with “enough courage” to pursue a case.

Judge Napolitano: Hillary Clinton Faces ‘Three Years In Jail, Per Document’ (Video)

“But the other problem that she faces is far more serious, and that is a conspiracy to deflect documents, to conceal documents from government computers by keeping them from the government computers,” he said.

Fox News senior judicial analyst Judge Andrew Napolitano said Thursday on “America’s Newsroom” that former Secretary of State Hillary Clinton is potentially facing prison time for hiding documents from government computers.

“So you feel that she faces potentially two criminal investigations?” asked host Martha MacCallum.

“Yes,” he agreed. “This is beyond extraordinary and beyond dangerous. This is potentially criminal.”

Naplitano compared Clinton to General David Petraeus: “The general agreed to plead guilty for keeping classified secrets in a non-secure, non-government-approved venue — in the general’s case, a desk drawer in his home. In Mrs Clinton’s case, the server in her home, non-government secured and non-government approved, classified secrets there, that is a misdemeanor.”

Obama power grab triggers 1st Amendment nightmare

Judge Napolitano: ‘People don’t know the danger that is coming.’

Fox News Channel senior judicial analyst Judge Andrew Napolitano says the Obama administration’s efforts to regulate the Internet constitute a major infringement upon freedom of speech, but he believes the new plan will get struck down in court for lack of transparency.

The five members of the Federal Communications Commission, or FCC, are scheduled to vote Thursday on a plan to advance Obama’s net neutrality agenda, which also allegedly calls for the Internet to be treated like a utility. Despite the major changes the plan could well involve, lawmakers and the media have been rather quiet about it.

“People don’t know the danger that is coming,” Napolitano said. “The danger that is coming is a gaggle of bureaucrats here – three Democrats and two Republicans, the Republicans will probably dissent – claiming they have the power to regulate the Internet.”

He said Congress has passed no statute authorizing new government controls on the Internet, and the First Amendment clearly states that neither Congress nor any government agency it created can make a law restricting the freedom of speech.

Judge Napolitano: Impeach Obama for amnesty

‘There’s a perfectly acceptable remedy right there in the Constitution that’s bloodless’

Fox News Channel Senior Judicial Analyst Andrew Napolitano is unimpressed by states suing the federal government over President Obama unilaterally changing immigration laws or by House Republicans pushing legislation to forbid Obama from moving forward in implementing his policies.

Napolitano, who has a weekly column at WND, is also not urging lawmakers to defund enforcement of what many on the right consider amnesty. Instead, the former New Jersey Superior Court judge thinks Obama’s actions warrant his removal from office.

Earlier this week, 17 states, led by Texas Attorney General and Governor-Elect Greg Abbott, filed suit against the federal government. Napolitano said that’s not going to get the job done.

“They can file all the lawsuits they want and the court is going to say, ‘Tell your client, Mr. Boehner, tell your client, Senator McConnell, that there’s a perfectly acceptable remedy right there in the Constitution that’s bloodless, and they can do it by taking a couple of votes,” Napolitano said. “It’s called impeachment.’”

Republicans from leadership to moderates to the most rock-ribbed conservatives have all dismissed any speculation about impeachment since they clearly don’t have the votes to convict Obama in the Senate and they believe it will backfire politically heading into 2016. Nonetheless, Napolitano finds that GOP position baffling.

“For some bizarre reason that I have yet to understand, the Republican leadership in Washington believes that if they file articles of impeachment, this is going to elect Hillary president,” he said. “What? That’s a disconnect to me.”

Megyn to Judge Nap: ‘Does Obama Have an Adult Relationship with the Truth?’ (Video)

“It’s a sad state of affairs when this Harvard educated, University of Chicago Law School-hired, so-called constitutional scholar […] doesn’t understand the basics of the Constitution and the job and the role of the president of the United States,” Judge Andrew Napolitano said, stressing that Obama doesn’t have the authority to change or rewrite the law.

President Barack Obama denied to George Stephanopoulos that he had said he couldn’t go alone on immigration.

“The Kelly File” recently found 25 instances in which he said that he didn’t have the power to act on his own on immigration.

“This of course is not the first time that the president has changed his tune on a major issue to the American people,” Megyn Kelly said tonight, referencing Obama’s repeated pledge that those who liked their health care plans could keep them.

Napolitano: ‘Crazy’ to Let Terror Fighters Return to U.S., ‘Wait & See What They Do’ (Video)

“He forgot there’s a statute called providing material assistance to a terrorist organization,” Napolitano said of Comey. “So if he knows that Americans have been fighting with ISIS and he also knows that the secretary of state has declared ISIS a terrorist organization, that is more than enough evidence for him to arrest them upon their re-entry to the U.S. It is crazy to let them back in and wait and see what they do.”

Tonight on “The Kelly File,” Judge Andrew Napolitano weighed in on FBI Director James Comey’s remarks on “60 Minutes” about U.S. terror fighters.

“Ultimately, an American citizen, unless their passport is revoked, is entitled to come back. So someone who has fought with [ISIS] with an American passport and wants to come back, we will track them very carefully,” Comey said.

Judge Napolitano Explains Possible Jeopardy of Obama’s Immigration Plans

Senate Minority Leader Mitch McConnell added that Obama is simply waiting to “go around the law once it’s too late for Americans to hold his party accountable in the November elections.”

Though the Obama administration has been vocal about moving forward on immigration reform without Congress, Obama’s latest plan is to wait to enact immigration reform until after the midterm elections. However, according to Judge Andrew Napolitano, a Fox News contributor, Obama’s plans could be permanently halted if the Republicans gain control of the U.S. Senate.

Appearing on Fox and Friends, Napolitano outlined a “poison pill” scenario wherein the Republicans take back the Senate in November, and the newly GOP-controlled Senate nullifies actions taken on immigration reform.

Napolitano notes that the House and Senate could include language regarding immigration in a large, must-pass bill, a tactic that takes power away from Obama, who does not have line-item veto power.
